The Central Independent Trade Union and Civil Servants (CSIF) has presented a claim administratively against the Ministry of Finance and Public Administration so that publish once and for all the Royal Decree that develops teleworking in the General State Administration (AGE), the union that presides over Miguel Erase.

After this formal claim, CSIF points out that, under current law, The Executive will have a maximum of three months to publish the teleworking decree in the Official State Gazette (BOE). Otherwise, CSIF warns that it will take this issue to court through the Administrative Litigation route.

In April 2021, the then Minister of Public Administration, miquel iceta, signed an agreement with CSIF, UGT, CCOO and CIG for the development of teleworking in the AGE. Specifically, it was established that public employees of this Administration could voluntarily telework three days a week, while the remaining two days would be face-to-face.

In December of that same year, the Government submitted to a hearing and public information the draft Royal Decree that developed this agreement to implement teleworking in the AGE. After the hearing and public information period ended on January 4, CSIF denounces that eleven months have elapsed without the rule having seen the lightso it has proceeded to file an administrative claim for inactivity.

“In accordance with the provisions of the agreement of April 12, 2021, it can be concluded that the Administration to which we are addressing (Ministry of Finance and Public Administration) is obliged to comply with it and, therefore, to conclude the processing of the Royal Decree regulating teleworking in the State Administration, since not having done so already entails not only a reduction in the right to collective bargaining, but also the breach of the agreement itself,” CSIF alleges in its claim.

CSIF also recalls in its claim that the Ministry does not need anything more than to take the teleworking decree in the AGE to the Council of Ministers and publish it in the BOE so that it can become effective. The union explains that the Ministry of Finance and Public Function has held a meeting of the General Board to explain to the autonomous communities the content of the agreement recently reached with the unions on wages and working conditions, such as the aforementioned teleworking.

“From CSIF we demand the government to stop the propaganda“, has underlined the union, which has recalled that it did not support the salary agreement reached between the Civil Service and the CCOO and the UGT recently reached for assuming losses of purchasing power for public employees in the current context of inflation.
